Introduction

Responsible sales of alcoholic beverages are very important to Wijnhandel Dielen & Zn. (hereinafter: “LuxuriousDrinks.com”). LuxuriousDrinks.com is not allowed to supply alcohol to young people under the age of 18. This document, the guaranteed working method, describes how responsible distance selling of alcohol is implemented at LuxuriousDrinks.com.

In other words: it explains how the legal age limit is guaranteed at LuxuriousDrinks.com from the moment of ordering until the moment of delivery. In this way, we comply with the requirement laid down in Article 20a(1)(b) of the Dutch Alcohol Act that a method must be in place which ensures that alcoholic beverages are only delivered to the address of the addressee (or a designated pick-up point) and that the age of the person receiving the alcoholic beverage is verified, and that this method is actually used in practice.

This document is up to date and can be requested at any time. It is reviewed and updated at least once a year (following an evaluation) and whenever relevant circumstances change.

The guaranteed working method describes:

1. How LuxuriousDrinks.com, together with its chain partners (delivery services), monitors the age limit from order to delivery;
2. How LuxuriousDrinks.com ensures that this working method is clearly communicated to employees, own delivery staff and/or others working under its responsibility;
3. How LuxuriousDrinks.com checks compliance with this guaranteed working method and how any changes are implemented following evaluations.

1. Process – from order to delivery

(In accordance with Article 5.2(1)(a) and (b) of the Alcohol Decree)

• When placing an order, the customer must actively confirm that he or she is 18 years or older. Entering a date of birth is mandatory. Without a valid date of birth, the order cannot be completed.
• LuxuriousDrinks.com hands over the shipment to Sendcloud with the instruction that an age check must be carried out. The carrier used via Sendcloud (e.g. PostNL, DPD or DHL) then checks the age of the recipient at the door.
• All age-restricted products are clearly marked with the NIX18 logo on the label or shipping packaging so it is clear to all parties (customer, staff, carrier) that the shipment contains alcoholic products.
• The delivery driver checks the age of the recipient by inspecting a valid identity document (ID card, passport or driving licence). The parcel is only handed over if the recipient meets the age requirement of 18+, in accordance with Article 20(2) of the Alcohol Act.
• If the recipient cannot present valid ID, or if it is established that the recipient is under 18, the parcel will not be delivered and will be returned in accordance with the carrier’s return procedure.

2. Information for employees

(In accordance with Article 5.2(1)(c) of the Alcohol Decree)

• Every LuxuriousDrinks.com employee involved in sales, customer service, order processing or logistics is made aware of this guaranteed working method and of the legal 18+ age limit for alcohol.
• Information about NIX18 and this guaranteed working method is provided via:
  • internal emails and/or newsletters;
  • internal work instructions, manuals and procedures;
  • onboarding and periodic training or evaluations.
• New employees receive instruction on:
  • the Dutch Alcohol Act and the 18+ age limit;
  • the obligation to actively verify age in distance sales;
  • the role of Sendcloud and the carriers in performing the age check at the door.

3. Control and enforcement

(In accordance with Article 5.2(1)(d) of the Alcohol Decree)

• Customer-side control: The customer must enter his/her date of birth during the checkout process. Without this information the order cannot be completed.
• Control at delivery: For any shipment containing alcoholic products, LuxuriousDrinks.com requests an age check via Sendcloud. The delivery driver from PostNL, DPD or DHL checks the age of the recipient at the door by inspecting a valid ID and only hands over the parcel if the recipient is 18+.
• Periodic evaluation: This guaranteed working method is evaluated at least once a year, or earlier if there are changes in legislation, logistics processes or IT systems. The document is updated where necessary.
• Measures in case of non-compliance: If it appears that employees or external parties (such as carriers) do not comply with the agreements laid down in this guaranteed working method, LuxuriousDrinks.com may take the following measures:
  • additional instruction or (re)training;
  • adjustment or tightening of procedures;
  • in case of repeated or serious violations: disciplinary measures or termination of cooperation.
